Several questions on legal issues are answered. The Texas UCC reads: "(d) If an instrument is payable to two or more persons alternatively, it is payable to any of them and may be negotiated, discharged, or enforced by any or all of them in possession of the instrument. In Texas, a Uniform Transfers to Minors Act account can have only one custodian. The IRA agreement dictates the distribution of assets upon an IRA owner's death. Usually when the sole primary beneficiary dies before the IRA owner, the assets pass to the contingent beneficiaries. It would not be pyramiding if the late fee charged is for the late payment and is not due to the charging of late fees.
