This article offers a reassessment of the state action doctrine as it applies to the anticompetitive conduct of municipal actors like the airport authority in the SARAA cases, with particular focus on the exercise of eminent domain. Part II of the article briefly outlines the fundamentals of federal antitrust law before turning to a discussion of the creation and ...

  • My interpretation of Perry Klopfenstein's letter ("Intelligent design deserves inclusion," Your Views, March 15) is that he thinks that the ideas of creationism and intelligent design should be taught in natural science courses in public schools, and that doing so would not violate the separation of church and state. Judge John E. Jones III of the U.S. District Court for the Middle District of Pennsylvania disagrees strongly - Memorandum Opinion; Dec. 20, 2005; Case No. 04cv2688; Tammy Kitzmiller, et al., Plaintiffs v. Dover Area School District, et al., Defendants.

  • The Food and Drug Administration (FDA) is issuing an order under the Federal Food, Drug, and Cosmetic Act (the FD&C Act) permanently debarring Stephen L. Marks from providing services in any capacity to a person that has an approved or pending drug product application. We base this order on a finding that Mr. Marks was convicted of felonies under Federal law for conduct relating to the regulation of a drug product under the FD&C Act. Mr. Marks was given notice of the proposed permanent debarment and an opportunity to request a hearing within the timeframe prescribed by regulation. Mr. Marks failed to respond. Mr. Marks' failure to respond constitutes a waiver of his right to a hearing concerning this action.
