A late response to a request for admissions owing to an attorney's oversight should not mean the end of the road for a client attempting to sue her doctor for battery, the Court of Special Appeals has concluded. In an October decision released last week as a reported case, the court reversed the Baltimore County Circuit Court's grant of summary judgment in favor of Dr. Lawrence Boas. The circuit court erred, the appellate court held, in failing to allow plaintiff Corinne Gonzales the opportunity to withdraw the statements deemed admitted as a result of her late response.

Trial court did not abuse its discretion in concluding that Ohio Consumer Sales Practices Act defendant had not committed a violation knowingly, and in declining, therefore, to award attorney’s fees. Plaintiff under the Act may not recover both treble damages and compensatory damages (that is, four times the amount of actual damages); an award of compensatory damages is subsumed in the treble damages award. In response to a request by the MU Faculty Council, University of Missouri Chancellor Brady Deaton has opened admissions to the nuclear engineering program and promised to keep the existing curriculum in place for the next five years. In March, University of Missouri Graduate School Dean George Justice announced the Nuclear Science and Engineering Institute would close.
