A Richmond, Va. lawyer who had a high-volume real estate practice has surrendered his law license after the state bar found long-time lapses in bookkeeping and registration as a settlement agent.
Dean Foster borrowed money to cover errors in his trust account that at one time totaled $176,000, according to the Virginia State Bar's findings. Foster's accounting was so sloppy that a staffer's embezzlement of $38,000 in 2004 or 2005 went undiscovered "until well after the fact," according to an affidavit signed by Foster that summarized allegations of misconduct.

LYNDHURST -- A Lyndhurst real estate lawyer has been charged with two counts of theft for allegedly falsifying the sales price of a residential property and pocketing the $75,000 difference, authorities said Friday.
Michael P. Rumore, 51, allegedly presented the seller of the property with a doctored federal settlement form that indicated that the sale price was about $75,000 more than the actual sale price, said John L. Molinelli, the Bergen County prosecutor. The HUD-1 form, which itemizes all of the charges imposed on a buyer and seller in a real estate transaction, listed several contractors who Rumore claimed had been paid about $75,000 for work done on behalf of the seller, Molinelli said.

Webb relocated to Florida several years ago. He continued operating, despite a December 2004 exposé in the Independent, being barred by state regulators in North Carolina and California from doing business in those states; and a lengthy civil case prosecuted by the U.S. Securities and Exchange Commission in Horida. The SEC case ended in July 2009 with a judgment against Webb in which he is "permanently enjoined and restrained" from operating the fraud scheme. In closing its case, the SEC retained the option to force Webb to surrender "ill-gotten gains" to be returned to investors, with interest SEC lawyers have been investigating Webb's personal finances since the judgment against Webb last summer and plan to return to court later this year to ask a judge to order the return of investor...
