A copyright system is designed to produce an ecology that nurtures the creation, dissemination, and enjoyment of works of authorship. When it works well, it encourages creators to generate new works, assists intermediaries in disseminating them widely, and supports readers, listeners, and viewers in enjoying them. If the system poses difficult entry barriers to creators, imposes demanding impediments on intermediaries, or inflicts burdensome conditions and hurdles on readers, then the system fails to achieve at least some of its purposes. Hales, a city commissioner from 1992 to 2002 and now a transit planning principal with the Portland office of HDR Inc., recently received some recognition for his work in the area of mass transit by being named a 2004 Trendsetter by Public Works magazine.

Recently, while at a Barnes and Noble book store, I noticed a woman with her arms loaded with children's books, stuffed animals and puppets. I overheard the cashier commenting on the number of items and asking if they were for her children. "No, or why, yes they are" the woman responded in a nonchalant manner. "These are for my students." I asked, "How long will it take you to get reimbursed for this purchase?" knowing full well she would never see her money again, but would have the joy of the investment she was making in her students and our collective future.
