Through this notice of proposed rulemaking (``NPRM''), the Economic Development Administration (``EDA''), U.S. Department of Commerce (``DOC''), proposes and requests comments on updates to the agency's regulations implementing the Public Works and Economic Development Act of 1965, as amended (``PWEDA''). On February 1, 2011, EDA published a notice requesting comments on improving the regulations. A 70-day public comment period followed from February 1, 2011 through April 11, 2011, during which EDA received approximately 170 comments. In addition, EDA conducted an internal review of its regulations. Louisiana is the only one of the 50 states which bases its legal system on civil, as opposed to common, law. As if the civil law difference was not enough, Louisiana's lien law is its own unique maze of rules and requirements, many of which mirror each other as between public and private projects. Being an expert in the complexities of the federal Fair Labor Standards Act isn't part of Bernadette Salazar's job description as senior human-resources administrator for Santa Fe County. Lien law in Louisiana is set forth in the Private Works Act, which governs if the owner, that is the party that hires the general contractor, is a private entity. The Public Works Act applies if the party that hires the general contractor is the State of Louisiana or a subdivision thereof. According to the Prive Works Act, a lien creates 2 kinds of rights: claims against the owner and the contractor, and a privilege in the property securing the claim against the owner. A claim is a direct cause of action so that the contractor and owner are directly liable to the claimant. The Public Works Act does not create any rights against the property. In January 2010, Oregon joined a growing list of states that have enacted false claims acts modeled after the federal one, which was first enacted during the Civil War. The Oregon False Claims Act imposes civil penalties against contractors who submit false or fraudulent claims for payment on Oregon public works projects. Although Oregon's act is similar to the federal act, there are some important differences.
