Pretty much everyone supports the idea of the University of Wisconsin-Milwaukee developing a unique School of Freshwater Sciences designed to deal with freshwater issues and help turn Milwaukee into a hub of freshwater industry. And it is a great idea. Where some part company is over where to put the school.
To us, the choice is clear: The best place for the new school is the proposed site at the former Pieces of Eight restaurant at the end of E. Michigan St. It's directly on the water, where scientists say they'd like to be. Given the right design, it would provide a showcase setting for a signature building that would serve as a gateway to the school's work and to the city. Under Washington's public trust doctrine, the state retains a jus publicum interest in tidelands, regardless of ownership. This interest obligates the state to protect the public rights encompassed within the jus publicum: navigation, fishing, boating, swimming, water skiing, and corollary recreational activities. The state satisfies this duty so long as its actions do not circumscribe public access to those resources, including tidelands, traditionally protected by the public trust doctrine. The title to any tidelands property sold into private ownership is similarly burdened; a private tidelands owner may not utilize property in a way that would compromise the state's jus publicum interest and public rights protected thereby.
