- Extension of Public Comment Period for Proposed Action on Arkansas Regional Haze State Implementation Plan and Interstate Transport State Implementation Plan To Address Pollution Affecting Visibility and Regional Haze
On October 17, 2011, EPA published in the Federal Register a proposed rule proposing to partially approve and partially disapprove the Arkansas Regional Haze (RH) State Implementation Plan (SIP) and to partially approve and partially disapprove Arkansas' Interstate Transport SIP to address pollution affecting visibility, and requested comment by November 16, 2011. EPA is extending the public comment period for the proposed rule until December 22, 2011.

THE state Public Service Commission does not like how Lackawanna Transport Co. operates a landfill in Wetzel County. The agency ruled in 2003 that Lackawanna cannot operate a sewage sludge facility at the landfill without a certificate of need. Lackawanna officials argue that the landfill's permit, issued in 1992, applies also to the sewage sludge facility.

On March 2, 2012, EPA proposed several related actions regarding a State Implementation Plan (SIP) submitted by Nebraska to address its obligations under the Clean Air Act (CAA) with respect to regional haze for the first implementation period. One such action was EPA's proposal of a Federal Implementation Plan (FIP) relying on the Transport Rule to satisfy Best Available Retrofit Technology (BART) requirements for sulfur dioxide (SO<INF>2</INF>) at one source in Nebraska to address deficiencies in the State's implementation plan for regional haze.
