Brian Brown was released recently from prison for a drug-related conviction. After nearly four years behind bars, he was placed in a halfway house and became one of the estimated 60,000 felons under court supervision in the District, according to the D.C. Public Defender Service.
Three weeks after the US Court of Appeals in New York City (2nd Cir) ruled that secret dockets violate the First Amendment, the Public Defender Service of Washington DC, on a Jun 24 motion, revealed that nearly 200 criminal cases are entirely under seal in District of Columbia Superior Court. The motion included an attachment containing a 16-page list of sealed cases gleaned from a computerized database maintained by the Superior Court. The appeals court responded on July 22 by issuing a three-page order reminding trial judges of the "strict conditions governing any request to seal a criminal record or close a criminal courtroom.

The U.S. Parole Commission is asking for comments on its preliminary plan for the retrospective review of its regulations to determine whether any of the regulations should be repealed, modified or expanded. A position of Federal Defender General should be created to enhance the public image of public defenders. Currently the adversarial system tends to favor prosecutors, making it hard for criminal defendants to obtain a fair trial. Semiotic theory shows how the criminal justice system reflects broader social discourse concerning crime. The defendants' rights are given symbolic representation but are not considered seriously. Criminals are set apart from the rest of society and regarded as undeserving of truly fair representation. The trial can be seen as an allegory demonstrating the guilt of the defendant.
