A professional liability insurance company could not compel arbitration when it was sued by an insured for failing to provide a defense, the Missouri Court of Appeals has ruled in affirming judgment.
The plaintiff is a masseuse who was insured by the defendant. The plaintiff sued for breach of contract when the defendant refused to provide a defense in a personal injury action filed by one of the plaintiff's customers.

Oklahoma Attorneys Mutual Insurance Co. has declared a 17.75- percent policy dividend for 2009. The dividend totals $1.2 million. The dividend will be paid to nearly 2,300 policyholders by the end of February. Dividends have been declared for 16 consecutive years.
