[Steven Politas] says 37 states, including New Jersey, currently have licensing and recognition for professional employer organizations, but NAPEO wants to see that expand to the entire nation. In particular, he says clarification is needed from the Internal Revenue Service in defining what [PEOs] are. "You have a lot of temp companies, staff augmentation companies, outsourcing companies that are not true PEOs," Politas says.
Using a PEO can eliminate the need for an in-house human resources department and give the client customers more leverage buying health insurance coverage, says John Powell, director of marketing for Extensis Group LLC, a Woodbridge-based PEO. Congressional intent appears to allow the IRC section 45B(b)(2) employment tip credit to professional employer organizations (PEO) which lease employees to food and beverage establishments. The issue has not been addressed by the IRS or the courts, but logic and legislative history point to a resolution in PEOs' favor rather than food and beverage establishments which do not pay the employees' wages. The tip credit was established under the Fair Labor Standards Act of 1938.

Professional employer organizations (PEO) are businesses that allow clients to outsource management of human resources, benefits, payroll, tax administration and workers compensation. According to the National Association of Professional Employer Organizations, an industry trade group, PEOs establish and maintain an employer relationship with employees at the client's worksite and contractually assume certain employer rights, responsibilities and risk. Because of the integral role workers compensation insurance plays in a PEO account, additional challenges track those commonly associated with the product itself.
