The Supreme Court's decision in Kelo vs City of New London expands and conflates the government's eminent domain powers until private use and public use become virtually a compound in one. This note argues that while legislatures should be allowed deference under a rational basis standard to declare takings for a public use in situations where public benefits are directly achieved, they should only be able to claim that takings resulting in indirect benefits to the public are for a "public use" after withstanding a heightened scrutiny of the legislature's purpose and plan in the taking.
