Some of the main points of principle that remain unresolved in connection with the interpretation and application of bilateral tax treaty nondiscrimination provisions are identified. This is done from the perspective of a U.S. tax practitioner who has only an outsider's passing acquaintance with other countries' interpretations of bilateral tax treaty nondiscrimination provisions and with the ECJ case law on the tax issues under the EC Treaty. So this does not purport to be a thorough catalogue of technical issues of interpretation, nor a systematic comparison of tax treaty nondiscrimination rules and the EC Treaty provisions. Some startling revelations have come out of the fracas going on in Wisconsin over Gov. Scott Walker and the Republican-controlled Legislature facing off against public-sector unions, namely the teachers union.
From 2001 to 2010, Wisconsin taxpayers paid more than $8 billion for state employee health care coverage, while state employees contributed $398 million, less than 5 percent of the total costs. From 2000 to 2009, taxpayers paid $12.6 billion for public employee pensions, while the employees contributed $55.4 million, less than 0.5 percent of the total cost.
