A federal district court judge in Denver will hear arguments in a 1 p.m. Friday hearing in a lawsuit seeking to overturn Colorado Springs' new "no-solicitation zone," which bans panhandling in some areas of downtown.
The suit, filed Wednesday by the Colorado American Civil Liberties Union, asks for a temporary restraining order and a preliminary injunction. The suit describes the zone as an "ill- advised ordinance that effects a breathtakingly broad suppression of First Amendment rights.

Although Civ.R. 65 mandates a hearing on a preliminary injunction only when a temporary restraining order has been granted, the rule nonetheless contemplates a hearing on a preliminary injunction where the facts and circumstances surrounding the motion so warrant, so that a trial court is required to exercise its discretion in determining whether a hearing is appropriate given the allegations and circumstances of any particular motion for preliminary injunction require a hearing.
