  • Earlier this month, New York's 150 year-old law requiring out-of- state attorneys to have a physical presence in the state to practice law was declared unconstitutional by Northern District of New York Judge Lawrence E. Kahn in the case of Schoenefeld v. State of New York. Section 470 (of the Judiciary Law) discriminates against nonresident attorneys by requiring them to maintain offices in- state even though resident attorneys are not required to do the same," Judge Kahn wrote in agreeing with the plaintiff, a New Jersey- based solo practitioner. "Most importantly, under Section 470, nonresident attorneys bear a significant competitive cost that resident attorneys do not. ...

  • I also learned a thing or two about the practice of law in New York. For years, since the 1840's, the apprenticeship program was the only route for Blacks to become practicing attorneys. Blacks had to work under white attorneys. This meant that Blacks, aspiring to practice law, had to show some "Calhoun," especially in New York. There is still zero tolerance for a competent, race-conscious Black lawyer. If Blacks were thinking-and not scared-there would be a demand for dismissing the bogus indictment in People v. [Michael Oliver] et al. on April 12, 2007 during "Confederate Month" in New York. This is appropriate since New York was in the Democratic column during the Civil War and was aligned, economically and politically, with the Confederate States of America. United African Movement ...

  • Even attorneys need to act carefully to minimize the risk of liability when filling a position. Lawyers and law firms are not immune from the concerns of all other employers just because they practice law," cautioned Rich Greenberg, a partner in the New York City office of the employment law firm Jackson Lewis. "We're not smarter than everybody else.

  • The new requirement, announced by Chief Judge Jonathan Lippman in his Law Day speech May 1, makes it mandatory, effective Jan. 1, for law school students to perform at least 50 hours of free legal service before they can be licensed to practice law in New York state. • [Alexander Hamilton Garland] was subject to a "nation of laws." The pardon power of a president under Article II, Section 2 of the U.S. Constitution extends to "Offenses against the United States, except in Cases of Impeachment." Borders, on the other hand, is subject to a "nation of men": "no Negro has any rights that whites are bound to respect. See: www.reinstatealtonmaddox.net for "Roller Coaster Ride for Blacks" and "Critical Lessons in Black History." When I was wrongfully suspended from the practice of law in 1990 for refusing to assist New York in its investigation of my client, Tawana Brawley, and the prosecution of my other client, Al Sharpton, in two indictments involving 70 counts, it follows that the New York Police Department can engage in racial profiling and the assassi...

  • [Smith]: The process of transporting them is to complete the module as much as it can possibly be completed in the factory. When it gets to the end of the line, we have a special canvas enclosure that we use to wrap them up. It's breathable, it has some large flaps that don't allow water in, but allow the air to move through it. What you don't want is for condensation to build up inside the module, thereby creating what could be potentially unwanted conditions with moisture and mold. Industry members say some advantages of this method include a more predictable construction schedule, a better quality building, less waste and cost savings. Members of the panel were Rich Smith, senior vice president of Kullman Buildings Corp. in Lebanon; Steven DeRochi, principal in Paulus Sokolowski &am...

  • A remnant of this policy can be found in the senseless and fatal shooting of Ousmane Zongo, an African immigrant. Bryan A. Conroy, a white police officer, shot him in the back in May 2003. The shooting of anyone in the back gives rise to a prima facie case of murder. The Manhattan Supreme Court has given the rogue cop a slap on the wrist. His sentence was probation. This sentence would be unusual if the victim had been a descendant of enslaved Africans. Blacks, born in the United States, learned during Hurricane Katrina that they are "refugees" absent international protections. The race of the offenders is the only factor that can be used to explain the judicial disparities in [Plaxico Burress] and [Omar Edwards]. Burress is Black and [Andrew Dunton] is white. The facts that gave rise t...
