The district court held that the expert testimony of Dr. Douglas T. Dietrich-the sole evidence of general causation submitted by Ruggiero-failed to meet the standards required by the Supreme Court decision in Daubert v. Merrell Dow Pharmacenticals20 and the federal rules of evidence governing expert testimony.21 Daubert provides that a district court might consider whether a theory or technique has been and could be tested . . . what its error rate was, and whether scientific standards existed to govern the theory or technique's application or operation.

We examine strategic alliances in an attempt to explain the increase in their use and the statistically significant increase in announcement day abnormal returns evident. Of the 10,141 strategic alliances we examine between 1983 and 2004, on average there is a statistically significant positive market response consistent with earlier research. Despite their increased use and positive announcement response, evidence suggests that approximately half of all strategic alliances result in negative shareholder wealth effects, perhaps portending impending alliance failure. Our research helps to differentiate those strategic alliances that are viewed favorably by the market from those that are not.

The trial court did not err in overruling the defendants motion to suppress evidence found after a search of a house where defendant and his girlfriend lived. Clear and positive evidence, which the trial court found to be credible, supported the trial courts conclusion that the defendants girlfriend was a co-inhabitant with authority over the premises, and that she had voluntarily consented to the search. Affirmed.

A study addresses two research issues. First, considering the current heightened scrutiny of managers and pressures on them to present unbiased financial reporting, does continue as it did twenty years ago at the time of Thomas' (1989) research? The results indicate that negative earnings firms no longer engage in this type of earnings management. Whether managers of negative earnings firms discontinued this activity because of the increased scrutiny is unknown, but this certainly represents one reasonable explanation for their change in behavior. For positive earnings firms, though, the evidence suggests that managers continue to round up the second earnings digit to increase the first digit by one. These results do ...

The Food Safety and Inspection Service (FSIS) is announcing proposed new procedures that it intends to implement when FSIS or other Federal or State agencies find raw ground beef presumptive positive for Escherichia coli (E. coli) O157:H7. This methodology will enable FSIS to better determine whether the establishments that produced the source materials for contaminated product have produced other product that may not be microbiologically independent from the contaminated product. The Agency is also announcing its intention to now, as a matter of routine policy, request a recall if an establishment was the sole supplier of beef trim source materials for ground product that FSIS or other Federal or State agencies find positive for E. coli O157:H7, evidence suggests that contamination mos...

This paper explores the relationship between economic freedom, political institutions, and conflict. We use a relatively new measure of peace that offers the unique advantage of capturing both internal and external conflicts, and we use a Freedom House measure of civil liberties for political liberties. According to our findings, countries with higher levels of economic freedom, other things equal, also have lower levels of external and internal conflict. In addition, we find a statistically significant relationship between the degree of civil liberty protection in a country and conflict. Our preliminary findings provide further evidence of the negative relationship between economic freedom and conflict (or positive relationship between economic freedom and peace).

Most observers agree that corporate social responsibility (CSR) is an important consideration for firms and their stakeholders. There is, however, disagreement in the literature about the motivation for firms to engage in socially responsible behavior. The CSR-Firm financial performance relationship has been investigated previously without substantial agreement about its nature or even its very existence. While CSR has traditionally been defined as a strategic 'process', empirical studies to date have been almost exclusively cross-sectional in nature, studying the immediate or short-term effects of CSR on firm performance. Nonetheless, many authors argue that the CSR-financial performance link should be studied over time. In this study, we use time series data to empirically analyze the...
