East Haven High School Athletic Director Fred Balsamo passed a polygraph examination that shows he did not sexually harass or have sexual contact with a female high school employee who has accused him of both actions, a lawyer representing Balsamo said Monday. "The polygraph found that there was no sexual harassment or no sexual contact between the complainant and Fred," said attorney Kevin Dineen, who represents Balsamo for any civil matter that may stem from the woman's charges.
The employee, through her attorney, Patricia A. Cofrancesco, has served notice that she intends to sue Balsamo, the Board of Education and several other school officials, charging that Balsamo sexually harassed her "on a consistent basis" on six occasions and that he sexually assaulted her Oct. 22, 2005.

The trial court did not err in overruling the defendants motion to suppress self-incriminating statements made to a polygraph examiner in the post-polygraph interview. Based on the totality of the circumstances, the statements of the polygraph examiner that he would personally recommend leniency in the form of probation and counseling did not constitute coercive police conduct to render the defendants confession involuntary. Accordingly, because we found that the defendant voluntarily made his confession to the polygraph examiner, we do not conclude that the second confession made to the Detective in an interview immediately following the post-polygraph interview should be excluded simply because it occurred in close proximity and time to the first interview.
