We hit a milestone in Tuesday's newspaper that made me so happy I just had to take note of it. On Monday, a California judge ordered pop star Britney Spears to forfeit physical custody of her two young children to her former husband because, in part, she failed to obey his orders to get a California driver's license and stop consuming alcohol around her kids.
A non-custodial parent is not entitled to an evidentiary hearing when the custodial parent decides to relocate, the California Supreme Court has ruled. When the parties divorced, the wife was awarded sole legal and physical custody of their son, following a psychological evaluation of both parties. Two recent appellate cases emphasize the necessity of applying the two-part test to determine whether a change in child custody provisions is required.
