A provision in a custody agreement providing for a lump-sum child support payment is not void as against public policy, the Nebraska Supreme Court has ruled. The mother and father were living together at the time an original paternity decree was entered establishing joint legal and physical custody of their child. No child support was awarded because the parents were cohabiting. The agreement was later modified to permit the father to make a $14,000 lump-sum child support payment, so that the mother could make a down payment on a house for herself and the child.
