In an interim win for Salisbury-based Perdue Farms Inc., a federal judge has ordered Tyson Foods Inc. to stop advertising that its chicken products are raised without antibiotics. The preliminary injunction will last while Perdue's lawsuit is in U.S. District Court in Baltimore. It applies to print, broadcast and point-of-purchase claims that Tyson's chickens are raised without antibiotics, or without antibiotics that impact human resistance to antibiotics. However, it does not apply to Tyson's labels, which are governed by the U.S. Department of Agriculture.
To Tyson Foods Inc., the signs that accompany its chickens in grocery stores are USDA-approved labels. To its competitor, Salisbury-based Perdue Farms Inc., Tyson's signs are false advertising. Either way, the signs say the same thing: they promise that Tyson's chickens are "raised without antibiotics," or a recently qualified version of that, "raised without antibiotics that impact antibiotic resistance in humans." But the classification could determine the outcome of the lawsuit now pending in U.S. District Court in Baltimore.
Gov. Mark R. Warner paused to pose for pictures at the Perdue Farms Inc. elevator and soybean processing plant Thursday, congratulating the company on securing new business shipping thousands of tons of soybean meal to Cuba. But as Warner put on a bright yellow hard hat and grinned broadly for the cameras, a big blue-and-white ship remained moored at the dock, days after it was supposed to have departed.
Salisbury-based Perdue Farms Inc. can proceed with its false- advertising suit against competitor Tyson Farms Inc., a federal judge has ruled. S. District Judge Richard D. Bennett denied Tyson's motion to dismiss the suit, and promised to rule on Perdue's motion for a preliminary injunction within a week.
Mrs. Letitia Gertrude Weaver of 7515 Jerusalem Plank Road, Disputanta, departed this life Saturday, Nov. 7, 2009, at Southside Regional Medical Center, Petersburg.
