LOS ANGELES (AP) - For the first time, a federal judge has declared unconstitutional a section of the USA Patriot Act that bars giving expert advice or assistance to groups designated foreign terrorist organizations.
In a ruling handed down late Friday and made available Monday, U.S. District Judge Audrey Collins said the ban is impermissibly vague in its wording.

PORTLAND, Ore. -- Two provisions of the USA Patriot Act are unconstitutional because they allow search warrants to be issued without a showing of probable cause, a federal judge ruled Wednesday.
S. District Judge Ann Aiken ruled that the Foreign Intelligence Surveillance Act, as amended by the Patriot Act, "now permits the executive branch of government to conduct surveillance and searches of American citizens without satisfying the probable cause requirements of the Fourth Amendment.

The plan began under the Bush administration. It is naive and disingenuous to even think that Obama deserves the credit for this operation that began years ago. At that time liberals screamed about the Patriot Act as unconstitutional, about closing Guantanamo, about the so-called torture (water-boarding) of terrorists, the trying of terrorists in the U.S. so they can have rights. All of those screams were about sound political and legal actions in response to the slaughter of 3,000 human beings in New York and Washington in 2001, plus all of the earlier killings in U.S. embassies in Africa and the Middle East.

EARLIER this month, U.S. District Judge Victor Marrero in New York declared portions of the Patriot Act unconstitutional. He ruled that the law violates basic personal rights by letting intelligence agencies such as the FBI secretly collect information about Americans' telephone calls, e-mails, Internet site visits and books borrowed or bought.
The anti-terrorism act authorizes clandestine surveillance without requiring the FBI to seek approval from any judge. It also forbids telephone companies, Internet service providers and bookstores to inform their customers that they're being spied upon.
