The House of Representatives recently passed HR3915 (Mortgage Reform and Anti-Predatory Lending Act of 2007) and the Senate has introduced S2452 (the Home Ownership Preservation and Protection Act of 2007). The Federal Reserve announced on Dec. 18 that it, too, will propose new rules to the Truth in Lending Act to further address the subprime mortgage crisis.
All these efforts are flawed. If the intent is to pass laws and promulgate regulation that will protect consumers and decrease the likelihood that this subprime crisis will happen again, then these proposals are horribly off the mark.

A proposal expanding the definition of a small bank holding company under the Fed's Small Bank Holding Company Policy and the risk-based and leverage capital guidelines for bank holding companies has been issued by the Federal Reserve Board. The policy statement facilitates the transfer of ownership of small community banks by permitting debt levels at small BHCs that are higher than what would be permitted for larger BHCs. Because small BHCs may, consistent with the policy statement, operate at a level of leverage that generally is inconsistent with the capital guidelines, the capital guidelines provide an exemption for small BHCs.

The financial sectors of many developing countries are being reshaped dramatically by the rise in foreign direct investment, or FDI. The growth in financial sector FDI, in which banks in industrialized countries establish branches and facilities in emerging markets, has drawn attention to the consequences of foreign ownership of banking resources. An analysis of research on "real-side" FDI -- investment into manufacturing and primary resource industries -- suggests that lessons in these industries apply to the financial sectors of host countries. Real-side and financial sector FDI can heighten the host country's integration into world business cycles through improved allocative efficiency, higher technology transfer rates, and greater wages.
