Concluding a doctor was not an employee of the defendant hospital, the U.S. District Court for the Western District of New York dismissed all of the doctor's claims.
In Barbara E. Salamon, M.D. v. Our Lady of Victory Hospital, et al., Judge John T. Elfvin determined the doctor was not an employee of the hospital based on the fact that the hospital did not have control over her practice. The doctor determined what patients to accept and treat, and diagnosed and treated her patients based on her own professional judgment.
