As the Verizon Communications Inc. strike stretches into its third week, the company is paying some North Jersey police departments as much as $2,500 a day for overtime and off-duty work so officers can provide round-the-clock protection for employees -- both those on strike and those crossing the picket lines -- at various facilities. In New Jersey, nearly 7,000 Verizon employees walked off the job on Aug. 7. This article examines the federal government's growing use of 18 USC § 1346 to prosecute public company executives for breaching their fiduciary duties. Section 1346 is a controversial but under-examined statute making it a felony to engage in a scheme "to deprive another of the intangible right of honest services."
