CRIMINAL - The trial court properly found Defendant to be a wrongfully imprisoned person, pursuant to R.C. 2743.48, where prior guilty plea was withdrawn as being constitutionally deficient due to ineffective assistance of counsel and as such, prior voided guilty plea could not bar his claim under statute. Trial court did not err by accepting as evidence the complete transcript of the subsequent murder trial finding the Defendant not guilty when determining if Defendant was a wrongfully imprisoned person. Further, trial court did not err by holding non-oral hearing on motion to determine if Defendant was a wrongfully imprisoned person when Defendant submitted only documentary evidence and the State did not submit any contrary evidence for court to consider.
