This article examines the contextual factors driving legal mobilization of workers in the United States through an analysis of national origin discrimination charges under Title VII of the 1964 Civil Rights Act (2000-2005). Consistent with previous studies, this analysis confirms that high unemployment levels and weak labor protections promote legal mobilization. The findings also highlight the positive role that civil society may play in promoting claims-making. I argue that nongovernmental organizations fill the gap in places where organized labor is weak, and may help support claims-making particularly in places with a larger vulnerable workforce. California, America's most populous state-with the dimensions, economy, power, and international ties, if not the sovereignty, of a nation-can and should play a leading role in attempting to break the U.S. legislative impasse on immigration policy and in forging policies to integrate immigrants more successfully into twenty-first century America. A first step in this direction might be to convene a non-governmental, bipartisan and multisectoral commission to make recommendations for consideration by the governor, the California Senate and Assembly, municipalities, California's congressional delegation, and the citizens, firms, labor unions, and other nongovernmental organizations of the state.
We're talking today to people who have decided to try to help improve the lives of folks in Afghanistan and Iraq. And I just marvel at the fact that Americans from around our country have heard a call to help somebody realize the benefits of freedom. And you know, governments can help, and we will help. And obviously, we've got a brave military trying to secure freedom in Afghanistan and Iraq.
