• Baltimore Judge Reduces Award to Arrested Deputy by $399,999

A Baltimore judge has slashed by nearly two-thirds a $600,000 jury award to a deputy sheriff who was arrested by a city police officer while both responded to a call concerning the mentally ill brother of the deputy's friend in May 2008. Baltimore City Circuit Judge Audrey J.S. Carrion, in granting a motion by the city, reduced the $400,000 "nominal" damages portion of the award to $1. The reduction cut the total award to $200,001.

Nominal damages are available under Sect. 1983 for a student who claimed his free speech rights were violated by a school policy prohibiting anti-gay comments, the 6th Circuit has ruled. The plaintiff claimed he believed that homosexuality was a sin and that he should speak out against the establishment of gay student groups, but to avoid punishment under the policy he refrained from speaking as he wished. He sued, claiming the policy chilled his right to free speech and seeking actual and nominal damages. The policy was later changed.

Deputy Sheriff Arthur 'Barry' Phillips had arrived before the city officer. Phillips and the officer argued when the officer told Phillips to leave, leading to the arrest. No criminal charges were filed against Phillips.
