A municipal law that seeks to prohibit illegal immigrants from obtaining rental housing is unconstitutional, the 5th Circuit has ruled in affirming judgment. Since 2006, the city of Farmers Branch, Texas, has made three attempts to regulate immigration in the rental housing context. The first ordinance was repealed after it was enjoined by a state court. A federal court found unconstitutional a second ordinance that prohibited landlords from renting to illegal immigrants. Enid city officials may decide this week whether to ask the Oklahoma Supreme Court to reconsider its recent opinion upholding a state law allowing municipal employees to unionize. Enid city attorney Carol Lahman said the city has until April 3 to seek a rehearing. The Enid Board of Commissioners will discuss their options Tuesday.
Beneath questions about whether University City attorney John Mulligan Jr. has a conflict of interest lies a snarl of other interesting connections. At a July 20 City Council meeting, two residents and a council member asked whether Mulligan had a conflict because he is slated to receive a cut of plaintiffs' attorneys' fees in a class-action lawsuit, according to draft minutes of the meeting and an article in the St. Louis Post-Dispatch. They also challenged the fees as excessive.
