Broward Circuit Court Judge Ronald Rothschild on April 10 denied a motion filed by attornevs for the church who sought a "more definite" statement from [Kevin Mullens], [Kevin Mitchell], Pat Davis and [Nathaniel Green], all of whom sat on church boards and are petitioners in the case.
I was unwillingly dragged into these proceedings after serving two full terms as the prior Chairman of the Board of Trustees," Green told The Broward Times. "It became absolutely necessary that I join the petitioners.
"To those who believe these petitions are wrong, I ask them what would they sugest," Mullens said. "The trustees tried to address serious issues via Christian principles, but we are left with no option but to seek an earthly solution," he said.

The trial court did not err in denying homeowners motion for relief from a default judgment when the homeowner failed to show that he was entitled to relief under one of the grounds stated in Civ.R. 60(B), particularly Civ.R. 60(B)(3), the portion of Civ.R. 60(B) upon which he had relied. Homeowner did not challenge plaintiffs status as the real party in interest in a timely manner. The trial court properly concluded that homeowner should have resolved inconsistency between allegations in the complaint and the documents attached to the complaint through a motion for a more definite statement. Judgment affirmed.
