An FBI investigation that led to a 68-count fraud indictment last year against Ronald J. O'Malley began with an inquiry into mortgage loans his firm brokered for the politically connected lawyer Dennis J. Oury, recently filed court documents show. O'Malley, 47, of Upper Saddle River, was the chairman of the Bergen County Improvement Authority, the county's public financing arm, when he was indicted last August in an alleged scheme to use his public post to boost his private brokerage business.

• The Pricing of Home Mortgage Loans to Minority Borrowers: How Much of the Apr Differential Can We Explain?

The public releases of the 2004 and 2005 HMDA data have engendered a lively debate over the pricing of mortgage credit and its implications regarding the treatment of minority mortgage borrowers. This research uses aggregated proprietary data provided by lenders and an endogenous switching regression model to estimate the probability of taking out a subprime mortgage, and annual percentage rate (APR) conditional on getting either a subprime or prime mortgage. The findings reveal that up to 90% of the African American APR gap, and 85% of the Hispanic APR gap, is attributable to observable differences in underwriting, costing, and market factors that appropriately explain mortgage pricing differentials. It is widely accepted that the recent real estate collapse was primarily due to lenders reducing, or disregarding the standards relating to home mortgage qualifications. Exacerbating these issues was having these same lending institutions bailed out, closed and reopened under another name. As a result of this collapse, President Obama signed into law on July 21, 2010, the Dodd-Frank Wall Street Reform and Consumer Protection Act (the "Act"). The stated aim of the legislation is "to promote the financial stability of the United States by improving accountability and transparency in the financial system, to end 'too big to fail,' to protect the American taxpayer by ending bailouts, to protect consumers from abusive financial services practices, and for other purposes.
