• Lawsuit Count Grows in Shepherd's Inquiry

A Fulton-based construction company has filed two more lawsuits in its ongoing battle with the Missouri Department of Labor over prevailing wage practices. Shepherd's Co. on Wednesday filed a federal suit against Larry Rebman, director of the Missouri Department of Labor and Industrial Relations, and Carla Buschjost, director of the department's Division of Labor Standards. Both are defendants in their official capacities and individually.

The dispute began over how much to pay workers to repaint a water tower in Monroe City. By the time it reached the Missouri Supreme Court, the case had attracted dire predictions about public infrastructure, tales of woe about school maintenance and a reference to the mythical Greek king Theseus. The Missouri Supreme Court solved the dispute March 1 -- sort of. In a unanimous opinion, Judge Mary Russell ruled that the water tower project qualified as "construction," and therefore the contractor must pay its workers under Missouri's Prevailing Wage Act. The contractor, Utility Service Co., had sought to classify it as a maintenance project, which would allow a lower wage to be paid.
