A nearly six-month-old Maryland law designed to bring certainty and clarity to power-of-attorney assignments has yet to fully achieve either goal, say elder law attorneys.
But the 2010 Maryland General and Limited Power of Attorney Act, which went into effect Oct. 1, is a marked improvement from the not- too-distant past -- when the mentally ill father of a state senator could unilaterally delegate authority over his financial affairs to a man he had recently met in a convenience store, the attorneys added.

Amid an imminent deadline, a group of property investors is seeking compensation from Maryland, saying a recent change in state law has rendered their rental investments essentially worthless.
Under the 2007 change, owners of "ground leases" must register their properties by the close of business Thursday or lose their ability to collect rent from their tenants. But that deadline is not at issue in the lawsuit, pending in Anne Arundel County Circuit Court.

The $30 million buzzword floating around the University of Maryland School of Law on Monday was "transformative." News of the W.P. Carey Foundation's record gift made an immediate impact -- the school has officially changed its name to the University of Maryland Francis King Carey School of Law.
But William Polk Carey, the foundation's namesake and Francis Carey's grandson, took a longer view during a ceremony formally announcing the donation.

The former state public defender and an assistant attorney general clashed before Maryland's top court Wednesday over whether a person who committed child sexual abuse in 1996 was validly required to register as a sex offender under the state's 1997 registry law.
Nancy S. Forster, now in private practice, pressed Kenneth Barnes' appeal before the high court, saying the 1997 Sex Offender Registration Act does not apply retroactively and thus cannot be part of the sentence for someone convicted of having committed a sex offense before the statute's effective date of July 1, 1997.
