After one of its slowest years in recent memory, the financial services M&A market remains uncertain over the timing of the economic recovery and impact of proposed regulatory, healthcare, and tax reforms, according to a new report issued by accounting firm Pricewaterhousecoopers. Optimism driven by an apparent recovery in GDP growth has been tempered by stubbornly high levels of unemployment. However, in the report, titled "On the Road Again -- Transactions in an Opportunistic Market", PwC says transactions are on the move again. Despite the fact that leverage is still scarce, private equity activity is increasing.
New York State Attorney General Eliot Spitzer recently announced an agreement to resolve an investigation of market timing by a leading financial services firm. Under the agreement, Prudential Equity Group will pay $270 million in restitution to injured investors. Under a separate agreement with the U.S. Department of Justice, Prudential will pay a penalty of $330 million. The agreements also require the company to undertake a series of reforms.

In their complaint, SEC officials say Mr. Calugar, through his Las Vegas broker-dealer firm Security Brokerage Inc., earned profits of US$175 million by engaging in late trading and market timing, mostly of mutual fund shares at Alliance and MFS.

Individual investors are the major long-term holders of Cubes and they hold and trade proportionately more Cubes than Standard & Poors Depository Receipts.
