Incriminating statements made by a murder suspect and his wife in the 2001 death of Memphis Code Enforcement inspector Mickey Wright can be used by prosecutors when the case goes to trial in March, a federal judge ruled Wednesday.
S. Dist. Court Judge Bernice Donald overruled a finding by a magistrate judge who last year said the statements by Dale Mardis and his wife were protected by the marital communications privilege and that Mardis earlier had asked for a lawyer.

Although the marital privilege prevents a wife from being compelled to testify about to confidential communications between herself and her husband, it does not bar her voluntary testimony, the Indiana Supreme Court has ruled.
The husband married the wife, who was a native of India, at least in part to keep her from being deported. They subsequently lived in the same apartment complex but in different units with different roommates.
