Manor Care of America Inc., a health care provider that moved its headquarters out of Maryland in 1998, may be eligible for coverage by a guaranty fund meant to protect Maryland residents if their insurers become insolvent, a federal appeals court has held. The question of residency is determined at the time a policy is purchased, not when the claim arises or is made, the 4th U.S. Circuit Court of Appeals held, reversing a ruling by the chief federal judge in Baltimore.
