Most insurance agents are aware that a standard personal auto policy does not cover all rental-car exposures. There's a gap between a renter's responsibility under the rental contract and what an auto policy will pay. About five years ago, rental companies began holding the renter liable for a "diminution of value" charge when a rental car was damaged. Most auto policies cover most of the repairs, but few cover diminution in value. To make a sound decision on transferring or retaining this risk, the renter needs accurate information. Providing that information is one of the primary responsibilities of an insurance agent. The agent who continues to tell clients that an auto policy will cover the majority of the damage to the rental car is misrepresenting his product. Such a statement can...

The Supreme Court has held that an individual relinquishes any Fourth Amendment interest in information that he or she voluntarily discloses to a third party. Known as the "Third Party Doctrine," this controversial rule is increasingly problematic in an age where a large proportion of personal communications and transactions are carried out over the Internet. Internet users expose virtually all of the information they generate online-e-mails, web-surfing histories, search terms, and more-to online service providers. As such, many scholars have assumed that Internet information will be unprotected by the Fourth Amendment. Yet the information disclosed to these online third parties is generally not exposed to human beings at all; rather, it is processed entirely by automated equipment. Ne...

When you try to use your credit card to cover collision damage to a rental car, the rental agent may lie to you about the coverage your card provides. I recently received e-mails from two readers reporting the same scam at two different rental companies: Agents told them that although their cards covered damage to the vehicle, they didn't cover the additional "loss of use" fee the car company would collect for the rental revenue lost while a damaged car was out of service. That statement is a flat-out lie.
When you rent a car, you're on the hook for any damage done to that car during your rental, plus loss of use, so you have to find some way to cover your risk. Rental companies, of course, are happy to sell "collision damage waiver" (CDW) or "loss and damage waiver" (LDW) essentially ...

EPA and NHTSA, on behalf of the Department of Transportation, are issuing this joint proposal to further reduce greenhouse gas emissions and improve fuel economy for light-duty vehicles for model years 2017-2025. This proposal extends the National Program beyond the greenhouse gas and corporate average fuel economy standards set for model years 2012-2016. On May 21, 2010, President Obama issued a Presidential Memorandum requesting that NHTSA and EPA develop through notice and comment rulemaking a coordinated National Program to reduce greenhouse gas emissions of light-duty vehicles for model years 2017- 2025. This proposal, consistent with the President's request, responds to the country's critical need to address global climate change and to reduce oil consumption. NHTSA is proposing C...

This amendment revises the Department of Labor's (DOL) regulations governing administrative claims submitted to DOL pursuant to the Federal Tort Claims Act (FTCA), the Military Personnel and Civilian Employees' Claims Act (MPCECA), and for payment of claims arising out of the operation of the Job Corps. The regulations governing such claims were last revised in 1995. MPCECA has since been amended to allow payment of up to $100,000 if the claim arose from an emergency or extraordinary circumstance. Further, the implementing authority for the Job Corps was changed to the Workforce Investment Act (WIA) since the last time the regulations were updated. These regulations are being amended to reflect those changes, improve the clarity and ease of use of the regulations, and to harmonize the r...
