Appellant had sufficient notice of charges, and convictions for sexual battery under R.C. 2907.03(A)(5) were supported by sufficient evidence and were not against the manifest weight of the evidence. Trial court did not err in refusing to add three sentences to instruction on definition of "in loco parentis" because the requested sentences were redundant and covered by other instructions, or would have misled the jury.

In this custody action between a parent and a non-parent, the juvenile court did not err in determining that the non-parent had to meet the standard in In re Perales (1977), 52 Ohio St.2d 89 and prove the parent to be “unsuitable” instead of the juvenile court proceeding in the best interest of the child analysis. The non-parent did not meet the Perales standard, despite her attempts at asserting that the parent contractually relinquished her right to sole custody by allowing the non-parent to participate as a “parent” and assume a substantial portion of the responsibilities of the child, as Ohio law does not acknowledge “partial” relinquishment.
