• Csa: Police Brutality Complaint Wasn't Notice Under Local Government Tort Claims Act

A convicted burglar who tried to sue Prince George's County for police brutality stemming from his 2001 arrest now finds himself shut out of court, since he failed to meet the notice requirements for bringing a tort action against the county. The Court of Special Appeals last week affirmed the dismissal of Thomas C. White's lawsuit, rejecting arguments that he either substantially complied with the Local Government Tort Claims Act or that good cause existed to excuse his noncompliance.

Plaintiffs suing cities and counties in Maryland must affirmatively state in their complaints that they have satisfied the statutory 180-day notice requirement of their intent to file a claim. Failure to do so will result in the dismissal of their case, even if they did, in fact, satisfy the notice mandate under the Local Government Tort Claims Act, Maryland's top court has held.
