A copyright system is designed to produce an ecology that nurtures the creation, dissemination, and enjoyment of works of authorship. When it works well, it encourages creators to generate new works, assists intermediaries in disseminating them widely, and supports readers, listeners, and viewers in enjoying them. If the system poses difficult entry barriers to creators, imposes demanding impediments on intermediaries, or inflicts burdensome conditions and hurdles on readers, then the system fails to achieve at least some of its purposes. The current U.S. copyright statute is flawed in all three respects. In this Article, I explore how the current copyright system is failing its intended beneficiaries. The foundation of copyright law’s legitimacy, I argue, is built on its evident ...

Despite the perception in some quarters that cartoons constitute an important medium for framing social issues, they are often dismissed on the grounds of political absurdity and ideological insignificance. Cartoons are seen as offering just "passing chuckles" rather than any "deep reflection" on social issues. The perception may be related to the cartoon's discursive spatial limitation and its very nature as a visual mode of communication. Visual modes of communication are deemed deficient in performing analytical communication. By grounding cartoons within a theory of visual semiotics and visual persuasion, this paper attempts to address some of the concerns raised about the effectiveness of editorial cartoons. It attempts to find out how cartoons, as uniquely visual forms of communic...

Carwin, Clara tells us, is still circulating, and the threats that he represents remain powerful and productive. Because Carwin continually evades normative attempts at classification and comprehension, he is less a threat to emerging Republican political praxis than a living testament to the democratizing power of unrestrained imagination, a power that continually and thrillingly reveals the precariousness of early American distinctions between deviance and normative belonging.5 II. [...] Carwin's escape is a testament to the powers of unrestrained imagination, to the power of words to undermine the often stultifying normative codes that comprise the social contract, and to the power of common men and women to throw into turmoil the social hierarchies that limit the ability for democ...

[Anne Ousterhout]'s biography provides a sweeping survey of Fergusson's life, from what Fergusson deemed the "sweet period of vernal innocence and youth" through her marriage and the increased economic, political, and personal hardships that she faced later in life (48). To reconstruct Fergusson's life, Ousterhout draws heavily on primary source materials such as letters, commonplace books, journals, and local political and historical records. She makes the most of what is, in reality, a rather limited number of texts by one of early America's most productive writers. Early in the biography, Ousterhout notes that most of Fergusson's written materials do not survive because her acquaintances complied with her request to burn her papers. In order to overcome this gap in the historical rec...
