Plaintiffs challenging Linn State Technical College's drug- testing policy scored two victories in federal court last week when the judge granted their motion for class certification and their motion for a preliminary injunction against enforcement of the policy. The American Civil Liberties Union of Eastern Missouri is spearheading the lawsuit against the publicly funded college.

Students enrolling in medical programs at the University of Missouri this fall were required to take drug tests -- a new mandate one local attorney says is unconstitutional. To make his point, attorney Dan Viets cites Linn State Technical College's attempt to screen its students this year. A U.S. district judge last week issued a preliminary injunction blocking those tests and warned the public college that she doesn't think the requirement passes constitutional muster.

St. Charles Community College has received a little more than $1 million in federal grant money to train area residents for work in the healthcare profession. A federal judge ruled that a policy at a public in Missouri forcing students to submit to mandatory drug tests as a condition of their enrollment is unconstitutional, the American Civil Liberties Union announced Wednesday. Late Tuesday, U.S. District Court Judge Nannette Laughrey, of the Western District of Missouri, granted a motion by the ACLU and the ACLU of Eastern Missouri for a preliminary injunction. Courts have consistently questioned the legality of routine drug- testing at public institutions such as colleges and universities. Recently the question was raised again over policies at Linn State Technical College and the University of Missouri School of Medicine. Both institutions require pre-enrollment drug tests for students. Recently a federal judge issued a temporary injunction against Linn State, saying the policy probably violates the U.S. Constitution.
