The Oklahoma Legislature would be forced to comply with the state's open government laws under a bill filed late last week by a Guthrie Republican.
State Rep. Jason Murphey said House Bill 1805 would add the Oklahoma Legislature to the definition of public bodies under the state's Open Records and Open Meeting acts. The measure also would remove the Legislature's exemption from those statutes.

The New Jersey Supreme Court yesterday said that although there was no right to same-sex "marriage" in the state constitution, homosexual couples were treated unequally by the state and that lawmakers must find a way to correct this.
Although we cannot find that a fundamental right to same-sex marriage exists in this state, the unequal dispensation of rights and benefits to committed same-sex partners can no longer be tolerated under our state Constitution," said Justice Barry T. Albin, who wrote the 4-3 decision in Lewis v. Harris.

[Alan H. Schorr] is appealing to the Legislature to solve the problem by adding the words "independent contractor" to the definition of employees in the anti-discrimination law. "The legislature never intended to say it's okay to sexually harass people because they are independent contractors instead of employees," he says. "That's why it's important to spell it out in black and white.

Threshold Issue - Blight The New Jersey Constitution limits the use of eminent domain for redevelopment to "blighted areas." Over the years, the legislature and courts have expanded this definition beyond reason and included properties that are not being "properly utilized" or "other conditions, resulting in a stagnant or not fully productive condition of land." As is sometimes said, under this definition, 70 percent of the state meets this vague definition.
THE NEW JERSEY LEGISLATURE confronts the daunting task of balancing the constitutional rights of property owners with the need to revitalize distressed neighborhoods through the use of the states redevelopment laws. The notice for ordinances adopting redevelopment plans that entail the taking of private property should invite prope...

Editor's note: This is the second of three editorials looking at efforts under way to improve the state's open records and public meetings laws.
The Wyoming Association of Municipalities giveth - and, given the chance, would take away. In negotiations with the Wyoming Press Association and other groups on proposals for the Legislature for improving the state's open records and meetings laws, WAM has proposed a definition of public documents that is powerful: It includes all forms of communication in "paper, electronic or other physical form.

So, in 1978 the Michigan Supreme Court struck down no fault as unconstitutional, ruling that the state cannot require people to have insurance without some guarantee that rates will be affordable. The Supreme Court ordered the Legislature to come up with a definition for affordability which ensures "fair and equitable" rates for the consumer. But in a twist, the Legislature turned the Supreme Court's ruling on its head by defining affordability from the insurance industry's perspective, not the consumer's.
Since 1989, Michigan's rates have skyrocketed 69 percent, the fastest rate in the nation. Our $1,000 average premium is closing in on New Jersey's $1,100, the country's highest. And Michigan's $436 collision premium is the most expensive in the U.S.
Ironically, Michigan drivers were j...
