TAIPEI, Taiwan (HedgeWorld.com) - The gray areas in the new Taiwanese private placement legislation present offshore hedge fund managers with the greatest legal risk, said panel participants at the IPAQ-organized Hedge Fund Investments Taiwan 2006 conference in Taipei last week.
The several billion U.S. dollars that Taiwan investors have invested in offshore hedge funds could be increased, but the resounding question was at the conference was how. "The legal risk for onshore hedge funds is high, because people's interpretation of the legislation and the regulator's [interpretation] may be different," said Daniel Yang, deputy chairman of the research development committee at the Securities Investment Trust & Consulting Association of R.O.C. (SITCA).
