Big changes are coming to the two main services that have ruled the online legal research world. Thomson Reuters Legal introduced a new Westlaw platform called WestlawNext, which aims to simplify and streamline the front-end search experience and to provide superior results using new back-end algorithms. The big news in the new WestlawNext service is that users don't have to select a database to begin a search. Now users can just select a jurisdiction. In other words, you don't have to know where the answer is before looking for it. Meanwhile, Darrell Huntsman, VP of innovation initiatives at LexisNexis, says the new Lexis for Microsoft Office came from its close studies of how lawyers worked. Lexis for Microsoft Office offers a single search box, with results displayed in a window next...
Method Versus Methodology, Ethnography and Law, Studying Legal Texts, Structural Approaches, Studying Legal Cultures, and SocioLegal Research in the U.K. They provide pithy introductions to each of the sections, but it is in their opening statement on law, sociology, and method (it alone merits the price of the book) that the editors consider the interdisciplinary nature of sociolegal research as well as the challenges of working in a field in which most of its practitioners are academic lawyers, not social scientists, and therefore lack systematic training in both sociological theory and research methods.
This paper reflects on the literature on courts and politics in Europe and the United States. US-American Political Science has dealt for several decades already with the role of courts and judges as political actors, whereas this perspective has only recently emerged in Europe. The debates differ not only with regard to the number of articles, but also with regard to their content. This paper discusses the different research perspectives that are being pursued on both sides of the Atlantic. While a major part of the US-American literature investigates the politics of judicial action and the politicization of the legal system, research on European courts confines itself to analyzing the effects of judicial action, often describing them in terms of juridification. Based on a review of th...
A recent lawsuit brought by a former client against an international law firm has attorneys wondering: what is the best way to bill clients for computerized legal research fees? Earlier this year, Patricia Meyer of Patricia Meyer and Associates in San Diego filed a putative class action on behalf of J. Virgil Waggoner against the New York-based firm Chadbourne & Parke.
This article evaluates what various country-specific and cross-country empirical studies have and have not shown. By highlighting the findings and methodological limitations of these studies, this article proposes a research agenda which will provide a decisive answer to the debate on what are, or should be, the goals and means of bankruptcy law. Five indicators determine whether a particular bankruptcy regime is or is not optimal. The resolution of financial distress should: 1. Be equitable. 2. Be prompt. 3. Be cheap. 4. Maximize creditors' recovery. 5. Promote growth through its effects on the availability and the cost of capital. Bankruptcy's ultimate goal is maximizing creditor recovery rate while scrupulously preserving the absolute priority rule. The proceduralist and traditionali...
EDITOR'S NOTE: This story has been updated with the defense's opening statement. NEW YORK (Reuters) - A corrupt man or a legitimate stock researcher?
Comprehensive data repositories are an essential part of practically all research carried out in the digital humanities nowadays. For example, library science, literary studies, and computational and corpus linguistics strongly depend on online archives that are highly sustainable and that contain not only digitized texts but also audio and video data as well as additional information such as metadata and arbitrary annotations. Current Web technologies, especially those that are related to what is commonly referred to as the Web 2.0, provide a number of novel functions such as multiuser editing or the inclusion of third-party content and applications that are also highly attractive for research applications in the areas mentioned above. Hand in hand with this development goes a high deg...
