COLUMBUS -- Gov. Ted Strickland on Monday moved to take some of the politics out of one of a governor's key constitutional powers -- filling judicial vacancies. Article 5 of the state constitution says the legislative, executive and judicial branches of government are "separate and distinct, so that neither shall exercise the powers properly belonging to either of the others, nor shall any person exercise the powers of more than one of them at the same time. However, Article 7, Section 16 seems to contradict Article 5, because it specifies that when a governorship becomes vacant, "the president of the Senate shall act as governor until the vacancy is filled."
