  • A claim that was underlined by President Bush's recent, commutation of White House consort Lewis "Scooter" Libby's sentence for perjury and obstruction of justice in a federal probe of the leak of former CIA agent Valerie Plame Wilson's identity. Bush erased Libby's two-and-a-half-year sentence, a sentence Bush deemed to harsh, though lawyers say this is a standard sentence in obstruction cases. Monroe County Superior Court Judge Thomas H. Wilson, too, found the sentence "a grave miscarriage of justice" and ordered Genarlow's release. But the decision did not grant his freedom because Attorney General Thurbert Baker immediately filed an appeal with the state Supreme Court, arguing the decision could free as many as 1,300 child molesters in Georgia's prisons. One writer said that justice...

  • A lawyer who sued his neighbors for defamation must pay more than $3,600 in attorneys' fees to one of the defendants, even though an insurance company paid the entire legal bill, Maryland's top court held. The Court of Appeals rejected arguments that victims of frivolous litigation should not be awarded attorneys' fees that were paid by an insurer, as the defendants did not personally "incur" any legal expenses. The decision was a defeat for Forest Hill lawyer Michael C. Worsham, who was challenging an award of attorney's fees to his neighbor, Romualda Greenfield, in a dispute dating back more than a decade. Writing for the court, retired Chief Judge Robert M. Bell said Maryland Rule 1-341 authorizes an award of attorneys' fees when an action has been brought in bad faith, and its goal...

  • When Genarlow's mom came into my office, if you had said 31 months later we'd still be dealing with this and all of the things that happened, I would have said 'No way,'" said Brenda Joy (BJ) Bernstein, [Thomas H. Wilson]'s attorney. "When I looked at her, I said, 'Oh, we have to get the law changed,'" she recalled. "In retrospect, that was correct and yet a little Pollyanna-thinking that people would just see-just like in the Marcus Dixon* case they saw-and we would eventually get this righted. "We're in waiting mode," says Bernstein. "This has been such a long path. Everything that could be done on his behalf has been done. My lesson, as well as, I think, Genarlow's mom's and Genarlow's, has been letting go now and just waiting He's edgy and I have been edgy, and I've been trying to...
