In a recent policy reversal, the Department of Justice has, for the first time, pursued antitrust liability for “reverse payment” settlements. These settlements occur in the pharmaceutical industry when brand-name and generic drug companies settle patent-infringement litigation. In a reverse-payment settlement, the generic drug company agrees not to enter the market for some period of time and the patent holder agrees to give it something of value—often quarterly cash payments. The DOJ claims that such settlements should be analyzed under the rule of reason but in fact seeks an unwarranted presumption that reverse payments are unreasonably anticompetitive. WASHINGTON - Attorney General Eric Holder on Tuesday acknowledged serious mistakes in an arms trafficking investigation that allowed AK-47 assault rifles and other weapons to get into the black market, but he insisted the Justice Department is taking steps to ensure that never happens again.
Under pointed questioning by Republicans, Holder also expressed regret that the Justice Department had denied allegations of "gun walking" in a letter to Iowa Sen. Charles Grassley sent earlier this year.

The ranking Republican on the Senate Judiciary Committee on Wednesday called for the resignation of Assistant Attorney General Lanny Breuer, who heads the Justice Department's Criminal Division, saying accountability in the botched Fast and Furious investigation was overdue.

Weapons purchased during the Bureau of Alcohol, Tobacco, Firearms and Explosives' controversial "Fast and Furious" undercover investigation, which included the sale to "straw buyers" of hundreds of AK-47 assault rifles, have turned up at a dozen violent crime scenes across the Southwest, the Justice Department told a Senate committee.
In a letter to Sen. Patrick J. Leahy, Vermont Democrat and chairman of the Senate Judiciary Committee, and the committee's ranking Republican, Sen. Chuck Grassley of Iowa, the Justice Department confirmed that the illegally purchased weapons recently were found at the sites of at least 11 violent crimes.

This Note proposes that a combined litigation team of Department of Justice attorneys, Department of Defense attorneys, and Judge Advocates General can use the Uniform Code of Military Justice and the Military Extraterritorial Jurisdiction Act to prosecute alleged misconduct of civilian employees of private military firms that occurs abroad. The Supreme Court and lower courts have not always been amenable to the exercise of court-martial jurisdiction over civilians, but a recent statutory change in the Uniform Code of Military Justice makes possible such an exercise.
