A former Goldman Sachs employee did not violate federal criminal statutes when he allegedly took the investment firm's proprietary computer source code for use in another business, the 2nd Circuit has ruled in reversing his convictions. The defendant is a computer programmer. He worked for Goldman Sachs in New Jersey developing computer source code for the company's proprietary high-frequency trading system. He was hired by an Illinois firm to set up a similar system. Before leaving Goldman, the defendant allegedly encrypted and uploaded to a server in Germany more than 500,000 lines of Goldman source code for use by his new employer.
