Norfolk Southern Railway Co. is appealing an order to pay $1.2 million in damages to Alstom Power Inc. of Windsor, Conn., for failing to deliver power plant components to Alstom's customer in Maine on time. S. District Chief Judge Benson E. Legg held that Alstom is entitled to recover the damages under the Carmack Amendment to the federal Interstate Commerce Act.
