In 1994, the U.S. Supreme Court ruled that "deliberate indifference to the substantial risk of sexual assault" violates prisoners' rights under the Cruel and Unusual Punishments clause of the 8th Amendment. (Farmer v. Brennan)
In addition, there are international human rights treaties that clearly protect the human rights of prisoners. The International Covenant on Civil and Political Rights and the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment both prohibit torture or cruel treatment of prisoners, and states that they "shall be treated with humanity and respect."

ST. LOUIS, Nov. 18 /U.S. Newswire/ -- On Friday morning, Nov. 18, a group of a dozen peace activists will deliver an "indictment" against the owners of Aero Contractors, charging them with conspiracy to commit torture in violation of United States law, the United Nations Convention against Torture, and the International Covenant on Civil and Political Rights.
