A Czech Republic citizen sitting in the Allegheny County jail says in a federal lawsuit he'll be tortured and killed by bill collectors if the government sends him home to face criminal charges. Jiri Masopust applied for asylum under an international convention against torture recognized by the United States.
The Bush administration has extended a ban on "cruel, inhuman or degrading" treatment of detainees to U.S. interrogators abroad, broadening instructions that had been limited to personnel in the United States. Despite the official U.S. policy, the administration said it does not necessarily accept the extended ban as legally binding under the international Convention Against Torture.
In court, a witness testified that prison officials knew what was going on. "They turned a blind eye," he said. "They seen what was happening, but they pretended they didn't. In 1994, the U.S. Supreme Court ruled that "deliberate indifference to the substantial risk of sexual assault" violates prisoners' rights under the Cruel and Unusual Punishments clause of the 8th Amendment. (Farmer v. Brennan) In addition, there are international human rights treaties that clearly protect the human rights of prisoners. The International Covenant on Civil and Political Rights and the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment both prohibit torture or cruel treatment of prisoners, and states that they "shall be treated with humanity and respect."
